Applies to Polish beneficiaries only: upon request of the beneficiary, the national controller may carry out a prior assessment of a public procurement procedure conducted under the Public Procurement Law, i.e. an ex-ante verification. For this purpose, the beneficiary submits a request to the controller via the Correspondence module in CST2021 and provides the procurement documentation, namely:
- draft contract notice,
- draft Terms of Reference / Technical Specifications,
- draft contract.
An ex-ante assessment of documents for a given procurement can be carried out only once. The controller should complete the assessment within 21 working days; therefore, we recommend submitting draft documents for review well in advance.
The ex-ante assessment serves solely a preventive and advisory function. It may help avoid the consequences of breaches of the Public Procurement Law; however, the Controller is not responsible for the conduct of the procedure. Carrying out an ex-ante verification does not exempt the procedure from ex-post control nor does it exclude the possibility of identifying irregularities at the stage of verifying incurred expenditures.
